Before initiating formal dispute resolution, the Parties shall try to resolve disputes through informal negotiation for 30 days following written notice by one Party to the other.
Arbitration
Any dispute that is not resolved by negotiation shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be New Delhi, India. The arbitration shall be conducted in English before a sole arbitrator appointed by mutual agreement; if the Parties cannot agree, the arbitrator will be appointed in accordance with the Act. The award shall be final and binding on the Parties and may be entered and enforced in any court having jurisdiction.
Restrictions: Arbitration will be limited to disputes between the Parties. To the fullest extent permitted by law, class arbitration, representative actions, and consolidated proceedings are excluded.
Exceptions: Either Party may seek interim or injunctive relief from courts of competent jurisdiction where necessary (for example, to protect intellectual property rights).
These Legal Terms, together with any other policies posted on the Services, constitute the entire agreement between you and the Company regarding your use of the Services. If any provision is held unenforceable, the remainder will continue in full force and effect. Our failure to enforce any right is not a waiver of that right.
